In these Terms, you will find words that start with a capital letter and have a certain meaning. Here you can see the definition of each word.
1.1 Licensee: The person that was granted a License to use the Products.
1.2 Company: The entity providing the Products.
1.3 Licensor: The entity that granted a License to the Licensee.
1.4 Template Products: The specific products being provided by the Company.
1.5 License Grant: The permission given by the Company to the Licensee to access and use the Products under certain conditions.
1.6 Restrictions: The limitations placed on the Licensee’s use of the Product.
1.7 Fee: The cost the Licensee must pay to purchase a License.
1.8 Intellectual Property: The legal rights associated with the Product and its contents.
1.9 Disclaimer: The statement by the Company that the Product is provided “as is”.
1.10 Limitation of Liability: The statement by the Company that it will not be liable to the Licensee or any third party for any damages.
1.11 Termination: The right of the Company to terminate this Agreement at any time for any reason.
1.12 Refund Policy: A set of guidelines and procedures established by the Company that outlines the conditions under which a Licensee can request and receive a refund for the Products.
2. License Agreement
2.1 License Grant. Subject to the terms and conditions of this Agreement, Licensor hereby grants to Licensee a non-transferable license to use the Products solely in connection with one Confluence instance owned or controlled by Licensee.
2.2 Ownership. The Products are and shall remain the exclusive property of Licensor. Licensee acknowledges that it has no right, title, or interest in or to the Products except for the limited license granted herein.
2.3 Restrictions. Licensee shall not, and shall not permit any third party to: (a) copy, modify, or create derivative works of the Products; (b) distribute, sell, sublicense, transfer, or otherwise make available the Products to any third party; or (c) use the Products in any manner that violates any applicable law, regulation, or third party right.
2.4 Fee. A one time fee is due by the Licensee for the License. The Fee is charged by the Company when Licensee purchases the Products.
3. Intellectual Property
3.1 All intellectual property rights regarding the Products are and will always be vested in Licensor.
3.2 The intellectual property rights regarding cited standards are vested in the respectiveowners, including (but not limited to) International Organization for Standardization (ISO) and the International Electrotechnical Commission (IEC).
4.1 THE PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR QUIET ENJOYMENT.
4.2 The Products are a guidance on how to implement ISO/IEC 27001 internaly, and QC Analytics does not warrant that you will get certified.
4.3 All HR processes included in the Products should always be checked and compliant with local laws and regulations.
5. Limitation of Liability
IN NO EVENT SHALL COMPANY BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE PRODUCTS, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. COMPANY’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU, IF ANY, FOR THE PRODUCTS.
Company may terminate this Agreement at any time for any reason. Upon termination, you must immediately cease all use of the Products and destroy all copies of the Products in your possession or control.
7. Refund Policy
At QC Analytics, we strive to provide our customers with high-quality template documents that meet their needs. However, we understand that sometimes a product may not be suitable for a particular customer. In such cases, we offer a refund in accordance with the terms outlined below:
7.1 Refund eligibility. To be eligible for a refund, Licensee must meet the following conditions:
- The Licensee must have purchased the Products from QC Analytics.
- The Licensee must request a refund within 14 calendar days of the date of purchase, as stated in the Consumer Rights Directive (2011/83/EU).
- The Licensee must provide a valid reason for the refund request.
7.2 Valid reasons for refund. The following are valid reasons for a refund:
- The Licensee received a Product that was significantly different from the description provided on our website.
- The Products are unusable due to technical issues that are within our control and cannot be resolved within a reasonable timeframe.
- The Licensee purchased a duplicate product.
7.3 Refund process. To request a refund, the Licensee must contact us at email@example.com and provide the following information:
- The License number and date of purchase.
- The reason for the refund request.
- Any supporting documentation, such as screenshots or error messages.
Once we receive the refund request, we will review it and notify the Licensee of the refund decision within 7 days. If the refund request is approved, we will issue a refund to the original payment method used for the purchase within 14 calendar days from the day we received the refund request, as stated in the Consumer Rights Directive (2011/83/EU).
Please note that refunds may not be available in the following circumstances:
- The Licensee changed their mind or no longer needs the product.
- The Licensee did not read or understand the product description before purchasing.
- The Licensee made a mistake when purchasing the product, such as selecting the wrong product or entering incorrect information.
We reserve the right to modify this refund policy at any time without prior notice. Any changes will be effective immediately upon posting the revised policy on our website.
